WHERE WERE THE SOUL AND CONSCIENCE OF THE PEOPLE IN THE FDA

The bases and justification of the FDA (Food and Drugs Administration) in raiding the Dr. Farrah Cancer Center was basically that it failed to register its herbal products. But the truth is because the FDA did not act on the application of Dr. Farrah for the registration of her herbal products. Such inaction by the FDA which under the circumstances could have continued forever, the FDA’s drastic action to raid, was impressed with nullity as it was arbitrary and without due process. Instead, it should have chosen to act on the application first before jumping the gun.

Due process is not merely a stentorian term evincing a bygone ethic. It is a legal principle embodied under the Constitution that no one shall be deprived of life, liberty or property without due process of law, nor shall any person be denied the equal protection of the law. These clearly reveal the real sentiments of Dr. Farrah, her patients, relatives of her patients, and supporters as they poured out their endearments, syntax and all, to the FDA.

So many different herbal supplements flood our country sold by different outlets in every nook and corner and all of them had been approved by the FDA. To conduct the raid only for the Cancer Center of Dr. Farrah is without doubt discriminatory and violative of her right to equal protection of the law. Dr. Farrah’s Cancer Center cannot be singled out as illegal while the others on the same footing are legal for alike cannot be treated unalike. Otherwise, one would be subscribing to the sophistry: truth on one side of the Pyrenees, falsehood on the other! This representation cannot fathom nor countenance this legal 'somersaults.' The rule against the practice of blowing "hot and cold" by assuming one position to one party and another position to another group will, in the words of Elliot, prevent deception.

Worse, if the raid was executed while the application for registration was still pending for consideration by the FDA itself, the same is absolutely malicious, oppressive, and in bad faith. No amount of semantical juggleries could dim this fact. It bears to the most primitive of reasons, the recourse for a hugely priced favor by the FDA, and more in tandem with other brazen relevant damning circumstances indicates the impudent abuse of power and the detestable misuse of influence made the premature decision of the raid a reality.
